These terms are the agreement between you and Fresh Pineapple LLC ("we", "us") for the Ola Wellness app on iPhone and Apple Watch, its widgets, the online features it connects to, and the olawellness.app website (together, "Ola"). By downloading, opening or using Ola you agree to them. If you don't agree, please don't use Ola.
Apple's EULA. Your license to the iOS app itself comes from Apple's Licensed Application End User License Agreement (Apple's standard EULA). These terms add to that EULA; they don't replace it. If the two ever conflict about the iOS app, Apple's EULA wins. How we handle your information is covered in our Privacy Policy, which is part of these terms.
The short version:
- Ola is a wellness diary, not medical care. It doesn't diagnose, treat, cure or prevent anything, and its numbers, estimates and suggestions are not medical advice. Don't use it in a medical emergency.
- You must be 18 or older (or the age of majority where you live).
- Estimates can be wrong. Food data, photo and voice logging, and Kai's answers come from databases and AI models that make mistakes. Check what matters to you.
- Ola Pro is a subscription bought and managed through Apple: $12.99 a month or $99.99 a year in the US, each with a free trial for new subscribers. It renews until you cancel it in your Apple ID settings, and deleting the app doesn't cancel it.
- There's no account, and your diary/log stays on your phone. Keep your own backups; we can't restore what we never held.
- Use the online features fairly. Don't misuse our servers or try to get around limits.
1. What Ola is, and what it isn't
Ola is a personal wellness self-tracking app. It lets you keep food, macros, fasting, weight, sleep, activity and, if you choose, your menstrual cycle in one place, and it points out patterns in what you log.
Ola is not a medical device. It does not provide medical advice and does not diagnose, treat, cure or prevent any disease or condition. Calorie budgets, macro targets, fasting timers, pace and weight projections, cycle predictions, patterns and Kai's answers are general information based on what you log, for wellness purposes only, and are not a substitute for a doctor, dietitian or other qualified professional.
Talk to a qualified healthcare professional before you change how you eat, fast or exercise, and especially if you are pregnant or breastfeeding, have diabetes or another condition affected by food or fasting, take medication, or have a history of disordered eating. Stop and get help if you feel unwell. Cycle predictions are estimates and must never be used as contraception or to plan or avoid pregnancy. Don't use Ola in a medical emergency: call your local emergency number.
2. Who can use Ola
You must be at least 18 years old, or the age of majority where you live if that is higher, to use Ola. By using it, you confirm that you are.
3. License, the EULA and our property
Apple's standard EULA (linked above) grants your license to use the iOS app on Apple-branded devices you own or control, under the Usage Rules in Apple's Media Services Terms and Conditions. Within that license, you may not copy, modify, resell, rent or distribute the app, or reverse engineer it except where the law lets you do so despite this limit.
Ola, the Ola Wellness name, the monstera leaf logo and design, and all content in the app and on our website belong to Fresh Pineapple LLC or its licensors and are protected by intellectual property laws. These terms don't give you any right to use our name, logo or other trademarks.
4. Online features and fair use
Most of Ola works on your phone alone. Some features you can turn on send information to our servers or to service providers: online food search, photo and voice logging, and Kai, the chat assistant. What each one sends and what we keep is set out in the Privacy Policy.
When you use Ola you agree not to:
- try to get around usage limits, access controls, subscriptions or consent screens;
- use our servers or their keys for anything other than using the app as intended, or call them from anything other than the app;
- use Ola to diagnose or treat anyone else, or to provide medical services;
- send content that is unlawful, harmful, infringing, or not yours to share, including photos of other people without their permission;
- try to get Kai to produce harmful content, or use its answers to harm anyone;
- access our systems without permission, or probe, overload, scrape or disrupt them or anyone else's use of them;
- use Ola in any way that breaks the law.
We may set and change usage limits, and we may suspend or turn off an online feature for an install that breaks these rules or puts the service at risk. Online features depend on our servers and on outside providers, so they may sometimes be slow or unavailable, and we may change or stop them. The rest of the app keeps working on your phone if they do.
5. Food data, estimates and Kai
Nutrition values come from third-party databases (such as Open Food Facts and FatSecret), from labels you scan, from what you type, and from AI models that estimate food from photos and descriptions. Kai's answers are written by an AI model working from a summary of your recent days. We don't guarantee that any calorie, macro or nutrition figure, estimate or answer is accurate, complete or reliable: a portion can be misjudged, a food mistaken for another, or an answer can sound confident and still be wrong. Check anything important to your health, and don't use Kai or any estimate for decisions about allergies, medication, insulin dosing or other medical matters.
6. What you share with us
If you turn on photo logging, voice logging or Kai, you choose what to send. You keep ownership of your photos, words and questions. So that we can run these features and improve them as the Privacy Policy describes, you give us a worldwide, royalty-free license to store, process and use what you share for up to the period the Privacy Policy states (currently 90 days), after which we delete it. You can delete what you shared sooner from Settings. Please only share things you have the right to share.
7. No account; your data and backups
Ola doesn't need an account. Your diary/log is stored on your iPhone, not on our servers. You are responsible for keeping access to your device and for your own backups, using the app's export and backup tools or your device's. If you delete the app, lose or reset your device, or turn off backups, your data may be lost for good, and because we never held it, we can't recover it for you.
8. Ola Pro subscriptions, free trials and billing
Ola offers auto-renewing subscriptions that unlock Ola Pro features. The features each plan includes are shown in the app before you subscribe.
| Plan | Price (US) | Free trial for eligible new subscribers |
|---|---|---|
| Ola Pro Monthly | $12.99 a month | 3 days, then $12.99 a month |
| Ola Pro Annual | $99.99 a year | 7 days, then $99.99 a year |
Prices can differ by country or region and may include local taxes; the price that applies to you is the one shown in the App Store when you buy. All purchases are made through Apple's App Store and are subject to Apple's terms; we never see your payment details.
- Payment is charged to your Apple ID when you confirm the purchase, or, if you start a free trial, when the trial ends unless you cancel before then.
- A subscription renews automatically for the same length and at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current trial or billing period. Your Apple ID is charged for the renewal within the 24 hours before the period ends.
- Apple decides who is eligible for a free trial. If you have already had a free trial in the same subscription group, you may not get another.
- Any unused part of a free trial ends when you buy a subscription.
- You can manage or cancel a subscription at any time in iPhone Settings → your name → Subscriptions. Cancelling stops the next renewal; you keep Ola Pro until the end of the trial or period you're in. Deleting the app does not cancel a subscription.
- Refunds are handled by Apple under its policies. We can't issue refunds for App Store purchases ourselves.
- We may change subscription prices. Apple will tell you in advance and ask for your consent where its rules require it, and you can cancel before the new price applies.
9. Apple Health and other services
If you connect Apple Health, the app reads and writes only what you allow, as described in the Privacy Policy. Other services you connect through Apple Health, such as watches and rings, are governed by their own terms. We are not responsible for the accuracy of data they provide.
10. Disclaimer
To the fullest extent the law allows, Ola is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't promise that Ola will be uninterrupted or error-free, that any estimate or answer will be correct, or that you will reach any health, weight or fitness goal.
11. Limit of liability
To the fullest extent the law allows, Fresh Pineapple LLC and its members, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, for any loss of data, profits or goodwill, or for any health decision you make based on information in Ola, arising from or related to Ola or these terms. Our total liability for any claim related to Ola or these terms is limited to the greater of the amount you paid for Ola (through Apple) in the 12 months before the claim arose, or US $100.
Some places don't allow these exclusions or limits, so some of them may not apply to you. Nothing in these terms limits liability that can't be limited by law, or takes away rights you have as a consumer where you live.
12. Ending these terms
You can stop using Ola at any time by deleting the app; if you subscribe, also cancel your subscription through Apple, since deleting the app doesn't do that. Settings also lets you delete what you shared with us. We may suspend or end your use of Ola, or of its online features, if you break these terms. Sections that by their nature should last, including 5, 6, 10, 11, 13 and 14, continue after these terms end.
13. Law and disputes
These terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts located in Wyoming, and you and we agree to their jurisdiction, except where the law of the place you live gives you the right to bring a claim in your local courts. Before bringing a claim, please email us so we can try to resolve it informally.
14. Apple
These terms are between you and Fresh Pineapple LLC only, not Apple, and they add to Apple's standard EULA. Where Apple requires its own terms to apply to the iOS app, they do.
- Responsibility. We, not Apple, are solely responsible for the app and its content.
- Support. We are solely responsible for maintenance and support of the app. Apple has no obligation to provide any maintenance or support for it.
- Warranty. If the app fails to conform to any warranty that applies, you may notify Apple, and Apple will refund the purchase price, if any, for the app. To the maximum extent the law allows, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs or expenses from a failure to conform to a warranty are our responsibility, to the extent these terms don't disclaim them.
- Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your possession and use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws, including in connection with the app's use of HealthKit.
- Intellectual property. If a third party claims that the app or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
- Legal compliance. You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party terms. You must follow any applicable third-party terms, such as your wireless carrier's, when you use the app.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
15. Changes to these terms
We may update these terms as Ola changes. When we do, we'll post them here with a new "Last updated" date, and for significant changes we'll let you know in the app or on our website before they take effect. If you keep using Ola after the new terms apply, you accept them. If you don't, please stop using Ola and cancel any subscription.
16. Everything else
These terms, Apple's EULA and the Privacy Policy are the whole agreement between you and us about Ola. If any part is found unenforceable, the rest stays in effect. If we don't enforce a part right away, we haven't given up the right to enforce it later. You may not transfer these terms to anyone else; we may transfer them as part of a merger, sale or reorganization of our business.
